1. Who you are contracting with

Night Shift Buddy (the “Service”) is provided by Veianya Hansen (“we”, “us”). By using the Service you enter into an agreement with Veianya Hansen.

2. Acceptance

By accessing or continuing to use the Service you agree to these terms. If you do not agree, please stop using the Service. You confirm you are of legal age in your country, or have authority to bind the organisation you represent.

3. What the Service is

Night Shift Buddy is a wellbeing companion for overnight workers: a shift countdown, optional encouragement messages (some written by AI), short reset ideas, and an optional paid Crew Mode for sharing shift status with coworkers. It is not a medical device and does not detect, diagnose, or treat fatigue or sleep disorders, and it does not determine whether you are fit to work. Always follow your workplace's safety procedures.

4. Acceptable use

You must not:

• use the Service unlawfully, or for fraud, spam, or harassment;
• post content in Crew Mode that is abusive, hateful, or infringes anyone's rights;
• infringe our or anyone else's intellectual property;
• interfere with security, probe, scrape, or introduce malware;
• attempt to jailbreak or misuse the AI features, or generate illegal content;
• reverse engineer, resell, redistribute, or circumvent technical limits.

You are responsible for the content you enter, the prompts you submit, how you use generated output, and for verifying its accuracy. AI-generated messages can be inaccurate and are never professional, medical, or safety advice. We may remove content, filter or refuse output, and suspend accounts to enforce these rules. Rights-holders may contact us to request removal of infringing content; repeat infringers lose access.

5. Intellectual property

We retain ownership of the Service, its software, content, and branding. You get a limited, non-exclusive, non-transferable right to use the Service. You keep the rights to content you submit and grant us a limited licence to host and process it solely to operate the Service.

6. Payments and Merchant of Record

Crew Mode is a one-time purchase of $4.99 USD that unlocks the feature on your device.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

7. Availability

We aim to keep the Service running, but we do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, locally stored data can be cleared by you, and crew records are deleted as described in our Privacy Notice.

9. Liability

To the extent permitted by law, we are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Our total aggregate liability is capped at the amount you paid us in the 12 months before the claim. Nothing limits liability for fraud, death, or personal injury caused by negligence. You agree to indemnify us against claims arising from your content, unlawful use, or breach of these terms.

10. General

You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the seller's jurisdiction, and disputes will be heard by the courts of that jurisdiction. We may update these terms and will revise the date above.
